Terms of Service

These terms (the “Terms”) govern your access to and use of the Outbind pre-launch website and waitlist (together, the “Service”). Outbind is a product operated by Moece Limited, a company registered in England and Wales (“Moece”, “we”, “us” or “our”). By using the Service you agree to these Terms.

This copy is a placeholder and is provided for information only while the Service is in pre-launch. It is not legal advice and is pending review by our legal advisers; the final wording may change.

1. Acceptance of these terms

By accessing the Service, joining the waitlist, or otherwise submitting your details to us, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service. If you are using the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is intended for business and professional users, and by using it you confirm that you meet this age requirement and are able to enter into a binding agreement with us.

3. The service

Outbind is a pre-launch product. At this stage the Service simply lets you register your interest by joining a waitlist. Joining the waitlist does not create any contract for the supply of a product, and it does not guarantee that you will be granted access to Outbind, that the product will launch at all, or that it will launch on any particular date. We make no commitment as to features, availability, pricing or timing, all of which may change or be withdrawn at any time before launch.

4. Acceptable use

You agree to use the Service lawfully and in good faith. In particular, you must not: misuse, disrupt, overload or attempt to gain unauthorised access to the Service or its underlying systems; scrape, harvest or collect data from the Service by automated means; submit details that are not your own or that are false, or impersonate any person; or use the Service for any unlawful, fraudulent or abusive purpose. When Outbind launches, any use of the product to send communications must comply with applicable anti-spam laws, including the Privacy and Electronic Communications Regulations (PECR) and the UK General Data Protection Regulation (UK GDPR), and you remain responsible for obtaining any consents required for your own outreach.

5. Accounts and security

The waitlist does not currently require you to create an account or password. If, in future, the Service offers accounts or other credentials, you will be responsible for keeping them confidential and for all activity that takes place under them, and you agree to notify us promptly at legal@outbind.com if you suspect any unauthorised use.

6. Intellectual property

The Service and all of its content, including the Outbind name, logo, text, design and software, are owned by or licensed to Moece Limited and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Service for the purpose of registering your interest. You must not copy, reproduce, modify, distribute or create derivative works from any part of the Service except as expressly permitted by us or by law.

7. Privacy

Our Privacy Policy explains how we collect and use the limited personal data you provide when you join the waitlist, and the rights you have over that data. The Privacy Policy forms part of these Terms, and by agreeing to these Terms you confirm that you have read it.

8. Availability and changes

The Service is provided on an “as is” and “as available” basis. We may change, suspend or withdraw all or any part of the Service, and we may update these Terms, at any time. Where we make material changes to these Terms we will update the “last updated” date above and, where reasonably practicable, take appropriate steps to bring the changes to your attention. Your continued use of the Service after changes take effect means you accept the updated Terms.

9. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Subject to that, the Service is offered free of charge during pre-launch, and to the fullest extent permitted by law we exclude all implied warranties and will not be liable for any indirect or consequential loss, or for any loss of profits, business, goodwill, data or anticipated savings, arising out of or in connection with your use of, or inability to use, the Service.

10. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales. You and we agree that the courts of England and Wales will have exclusive jurisdiction to settle any such dispute or claim.
